10 minute break unpaid in Massachusetts?

I work in North Attleboro, MA, and I get a 10 minute break unpaid. I was recently informed by a friend that 10 minute breaks are supposed to be paid breaks in MA. Is this correct?

  1. Apparently there is no precise rule on this question. You may be able to get an answer from the DTA or the AG's office, see the links below. The only specific requirement is for a 30-minute lunch break if you work 6 hours or more. Reading everything together, you do not seem to be entitled to a break, so you would not be entitled to be paid for any break. Any applicable collective bargaining provision (union contract) might give you a break, or pay for a break. If you fall into a special category, e.g., disabled, pregnant, etc., there may be a separate rule.

    If you received an employee manual, handbook or other written set of rules and practices by your employer, you should look to that for an answer.


  2. It's the principle of the thing. You shouldn't be off the clock for a ten minute break, only for a 30 minute lunch.
