Question:

10 pnts...I am behind on two car payments and I tried to pay

a payment over the phone....They will not let me pay a car payment, they said I have to agree in two weeks for them to take the other payment out. I don't know if I will have the money, so I didn't agree. So they refused to take my payment. Can they do that? The reason why I am behind is I had to take maternity leave 2 weeks earlier than planned, and had to stay off work the full 12 weeks, per the doctor....no pay. I have the money for this car payment, and hopefully by next check I will have most of the money for it, I even asked if I can make the arrangement, and call them if the money is not in the account, and they told me no. I am trying to catch up,....and they won't let me pay! I can't come up with 526.00 all at once! I have other bills. I made sure I stayed current with my car ins. and my mortgage. Can a company refuse a payment?

  1. Most companies are not allowed to take something like that from you so long as you are paying something!!! I mean, if you talk to someone, just be firm and make sure you stick to your guns about how much you have and can pay. Most places try to play hardball and get you to pay what THEY think is acceptable but as long as you are paying SOMETHING, you should be able to keep the car.

I have been in your shoes, the best policy is an honest one, and from what I read you are truthful to your lender.  Make at least one payment, they will except it, most lenders say what your says.  If you can send a little more with it,  ask to speak to the manager of the loan company, always get a name, what time you spoke to any person about your payment, and try to write down what you both said if you can.  I found if I do all of the above it helps.  Lenders rarely turn down payments.  Always send check or money order so you have a copy of it.  The best of luck, at least your trying.

  3. just send them a check...they are trying to scare you [and seem to be doing it]...and yes they can demand the money you owe them...because...you are violating the contract you signed

  4. i'm not sure what kind of institution you're working with.  but most banks would be happy to get what they can out of you.  if you're two car payments behind, you're very close to having it repossessed.  That may be their premise.  "pay all now or we're taking the car"  can you contact your lender and ask for a loan manager or supervisor?  tell them you've got the payment for two months back and try to pay more than the car payment if you can.  then give him a very real expectation of when the other payment will be made.  

    smaller banks are easier to work with in these situations than big corporate banks, but someone there should have a heart, even if it's just a small one.

  5. Just send them a check in the mail for one of the payments, it's better to be behind one month than two. It also shows you are trying to keep up on the payments. I would call your state's Better Business Bureau and find out what the laws are in your state though.
