10 years they can report a bankruptcy on your credit report, is that from the filing date or discharge date?

Only one credit bureau is reporting my bankruptcy from 10 years ago, How can I get them to remove it? 10 years that is from when we filled. It stopped me today from being able to re-finance my home because it brought my middle score down to below 700. Need to clean it up ASAP. Help????

  1. Well under the bankruptcy code a bankruptcy is only supposed to be valid on your record I believe for 7-8 years. Call them and tell them they are in violation of the code and see if they'll remove it immediately.  


  2. It would all depend upon what type of BK was filed.  Here is a list of the CRA reporting time frames.

    Example Chapter 7:

    You file bankruptcy on January 10, 2003 and receive a discharge on May 30, 2003. The bankruptcy remains on your credit report until May 2013. (10 years)

    Example Chapter 11:

    You file bankruptcy on January 10, 2003. You receive confirmation of your chapter 11 plan on March 15, 2003. The bankruptcy remains on your credit report until March 2013. (10 years)

    Example Chapter 12 and 13:

    The court normally grants the discharge as soon as practicable after you complete all payments under your repayment plan (typically 3-5 years).

Sgt Big Red is right on the money again on his advice, to add to that...most credit bureaus will list the date that the item is to be removed....In your bankruptyc case, 10 years from the date of discharge.  If it's past that date, call the reporting agency and have them remove it.
