17 yr old inherits money - how do I get a court ordered proof of legal guardian - I am the mother?

My husband passed away leaving some money to our son who is 17 - the insurance company says they need proof that I am his legal guardian from the courts - do I need a lawyer or can I just go to the court and make a request by showing proper documents?

  1. Won't a certified copy of his birth certificate showing you as mother work?

Call the insurance company back and ask them exactly what documention they are looking for before you go to the courthouse.  But you may also want to check with a lawyer to find out what your legal responsibilities are regarding the $.  Often the $ must be kept separate from other funds and the guardian of the funds must be able to offer documentation that the guardian acted appropriately and all $ was used specifically for the minor.

  3. Yes, yes, yes....take advantage. Although this money is NOT yours, since he is 17 right now, you should open a trust for him. In this trust, you could set some rules and guidelines on how you want the money to be disbursed to him. My parents gave my kids bonds when they were born and the bonds were at values of $80,000.00. I opened a trust for them stating that they could only receive the money if they had a 4 year degree, if they took financial advice from an adviser, if they gave 10% to charity and if they invested 35%. Take advantage this way you know they'll spend the money wisely.
