Question:

19 year old broke 16 year olds nose?

last night there was a big fight at my daughters house and my 16 year old was standing by the flag pole out of the way. a 19 year old male launched at her and stared punching her in the face. the cops let him go saying that he was just trying to break up the fight!(by punching her in the nose 5 or 6 times even though she was no where near the fight) I paln to sue for pain and meddical expenses. do you think i will win the case even if the cops just let him go?

  3. If she has an actual broken nose that's proof... considering she is a minor and he is a male he could probably get in a lot of trouble. Find a good lawyer and sue.

  4. Yes, actually the boy who broke your daughters nose is a legal adult. And your daughter is a legal minor, which is a felony. The boy could have at lease 1 or 2 years jail time with bail for about $5,000 or more. He would also have to pay for medical bills which would probably be around $3,000 depending on the severness of the injury. Your best bet is to get a good lawyer and good witnesses to the fight. This is a situation that must be dealt with. Also in the government it helps to know that you are causcasian. And one last thing, please get your story correct, If not then you may face charges for lying to the federal government.

  8. sounds like an assault, by an adult. Sue him, and the cops. You have a great chance of winning the case if what you said is true and if you have enough witnesses to prove it.

Yes, you can win this thing.  Yes you can.  You need to take this question to a  contingency lawyer.  Cops are idiots and they are NOT the final say in legal matters.  In fact, they are law enforcement....not Lawyers.  Take this question to a lawyer and ask for a 7 figure settlement.  Do this and let me know how it turns out.  Do Not be afraid to ask for financial restitution.

  10. Depends on the police report. Important considerations are that your daughter wasn’t doing something stupid to begin with and was a true innocent bystander. The judge won’t take kindly to instigators coming with their hands out. Another consideration is if this kid that hit her has anything worth taking. He likely is civilly liable if the facts are as simple as you represented, but you can’t squeeze blood from a turnip. A judgment against him in civil court means nothing unless he has the resources to pay you. 9 times out of 10 the case is not worth pursing because of this factor. There is likely a case for assault and battery here in civil court but really look at the circumstances; this sounds ridiculous and frankly your daughter (the home owner may be liable also) … I mean was this the middle of the night, why was your daughter there, what was the fight about, why were you not supervising your daughter, was there drinking … I don’t want to be discouraging, but normal functioning member of society do not physically accost each other and the judge considers these things. Therefore, your 16 year old should not be in the presence of these types of people and the judge will consider that and will also consider that you allowed her over to your daughters house where your daughter is associating with people that physically attack each other and will beat a 16 year old girl. This sounds messy, but there likely is a case but winning it hinges on the above considerations. Good luck.

I doubt that you are getting the whole story from your daughter.  She was probably somewhere she shouldn't have been.  You would have to be the one that files the charges against the 19 yoa.  Your daughter is a juvenile and she can't file charges....she can only be a victim/witness.  Call the pd and get the report and get the whole story.  As far as suing.....you can do anything you want in civil court.  Just make sure you get the whole story so you don't embarrass yourself when you retain an attorney.
