3 day 30 day 60 day notice to evict in California?

Hello, I received a 30 day notice to quit on 7/10. Today (7/11) The landlord came by again and handed me a 3-day notice to pay or quit dated yesterday and the same 30-day notice to quit all dated 7/10.

I read somewhere that if I lived here for more than a year, he has to give us 60 days instead of 30.

We have a strange situation as to why I'm not paying rent, I'm not going to go into that now, i'm hoping this does go to court because this landlord is not handling things the right way.

I'm just curious about court proceedings, will this 30 day notice hold up in court enough for him to get an eviction hearing after this 30 days? since we've lived herelonger than a year or does he need to give us 60 days?

I have physically live here 2 years, the landlord knows I've been here 2 years, but I have only been included on the lease for 1 year minus 3 days. Our lease was signed 7/15/07, but we lived here longer than that, it was only signed late because he was busy.

  1. You did not pay rent, the 3 day notice is valid.

    The 30 day notice is meaningless, because the 3 day notice takes precendence due to your non-payment.

    If you do not pay rent or vacate in 3 days, an eviction will be filed.

    The landlord was likely trying to cover his bases by giving you the 30 day notice. If you paid up within the 3 days, the 30 day notice would kick in.

    The landlord's 30 day notice is invalid, 60 days notice would be required, but only if you paid your rent within the 3 days.
