Court rejects EU treaty block bid

All 27 members states must ratify the treaty before it becomes law

An attempt to block Britain's ratification of the Lisbon Treaty has been rejected by the High Court.

Conservative MP Bill Cash sought a judicial review of the ratification process after Ireland rejected the treaty in a referendum.

He said it would be unlawful for the UK government to continue with it.

But in a ruling, Mr Justice Collins said: "It will be for Parliament, not the court, to decide whether the Bill should be passed."

He said ratification was "a matter of political not judicial decision" and Mr Cash's case was "totally without merit since it is an attempt to pursue a political agenda through the court".

'Disreputable'

Mr Cash said he was now considering whether to pursue the case further by seeking an oral hearing in court.

He described the government's decision to continue to ratify ...

  1. They will have to accept that the specific treaty is dead....so it will be back to the drawing board.

(By the way you have missed the point of the Daniel narrative)

  2. Err surely if an (unelected) judge says that ratification is a not a matter for the (unelected) courts, but a matter for the (democratically elected) parliament to decide that is a blow FOR not against democracy ?

If parliament acts against the wishes of the people then THAT is a failure of the Democratic process, but the judge was spot on.

That's not saying I think the treaty should be ratified, and personally I think there should be a referendum..... but that wasn't your question.

  3. Another step towards totalitarianism. We were promised a referendum, we should have one.

  4. By  being deceiptful to the British electorate will prove to be Gordon Brown's undoing! This legislation will put the Labour Party in Opposion for 10years!

  5. Dude,

after Gordon Brown broke his promise for a referendum, he said today in Bruxels, deep breath and try not to laugh, "the people of Britain SUPPORT the Lizbum treaty." So how did he figure this out? Did he ASK anyone? I don't think so!

As for the poor people of Ireland, looks like they'll have to have ANOTHER vote, and this time they'll have to vote YES, or else.

    Gordon Brown IS Robert Mugabe

  6. You don't see the CONTRADICTION going on here do you. You on one hand are fighting for your ELECTED GOVERNMENT - which you think should prevail over the EU - not withstanding that we also elect the EURO MPs too. But anyway, if the ELECTED GOVT does not do what we want, what the F*K is the good of it all.

    FOR INSTANCE

1 most people did not want the Iraq war - we got that anyway

2 most people want reduced fuel tax - we got high taxes anyway

3 People wanted a referendum on the treaty - we did not get that anyway..................ETC

DO YOU SEE A PATTERN HERE?

The Govt we love does not give two fks about us so why do we care. Anyway one of the bits of garbage spurted by the anti EU types is that we will lose our sovereignty and OUR QUEEN!!! But the queen is going to sign the papers anyway and the govt - who will have more than us to lose and  not worried at all. So you can see these fears are completely unfounded and are based on lies and misinformation.

Do you seriously think these greedy politicians will hand power over to another lot of greedy politicians unless they were dead?

  7. It is just the thin edge of the wedge!

Just wait until the E.U. has total power over all its "states".
