Question:

504 for asthma?

I wrote a formal letter requesting a 504 for my daughter who has asthma. I attached a note from her doctor stating she would benefit from working in a classroom with air conditioning. I later realized she has an IEP for speech services (she is a regular ed student)

My questions are:

1. I want to make sure I cover everything she needs in this document.any suggestions or experience with past asthmatic children with a 504 of what else I should put in?

2. Since she has an IEP for speech already (and her annual meeting is scheduled for 6/10) would it just be covered then and be inserted into the IEP?

  1. How can your child have an IEP and you don't know it from the start??  This is ILLEGAL !

    I assume you do not have your child's IEP plan?? Get it immediately!!

    If she has an  IEP for speech, she is a SPECIAL ED student and NOT a REGULAR ed student.

    If a child has an IEP plan, they are already covered by 504. You do not need to call a 504 meeting, cancel it.

    What you do is adress all the concerns at the IEP meeting. Everything that is decided upon will be written in the IEP plan.

    Your school doesn't have air conditioning??

    504 mandates that the school is suppose to help with 'breathing'....  this is one of the categories that is covered under 504.  PLEASE get a copy of the 504 law that states this and take it to the meeting to show them when they say they can't get the air conditioner.

    But even doing all  this, it will be about impossible to get them to have this air conditioner because --

    1. They will say it's too much money (even though by IDEA law this reason is ILLEGAL)

    2. Schools do not have any enforcement to make them do right and follow the laws, so they will tell you any old thing to get out of providing it)

    3. You will have to fight like crazy to get the air conditioner even if you are in the right and legally entitled to it. THey are not going  to agree without a fight.

    When they say NO, and I am sure they will, there is more you can do.

  2. In my state-a person could receive speech services and air conditioning in a 504 plan-

    An IEP is generally only needed if the student is getting curricullum modifications (not just accommodations) from a special ed teacher. A student with an IEP shoudl have an eligibility classification such as Other Health Impaired (OHI) or Communication Impaired (CI)

    Soem states may use an IEP for more than actual special education-for only related services for example-

    You will have to meet with the school-if you can get both the speech and AC with a 504 plan-that is the most appropriate plan-

    If not-than you need an IEP

  3. get ahold of the asthma foundation and ask for help
