Question:

6 months suspension for first time DUI Offense???

My girlfriend got a DUI back in June in the state of California, Placer County, and she was a first time offender. She completely co-operated with the police and they even made many mistakes on the police report which her attorney was supposed to fix. Come to find out they the attorney never fought for her and now she is getting her license suspended for 6 months. First time offenders, even if they fail all the tests only get it taken away for 4 months. Is there anyway at all at this point that we can fight to get it down to 4 months. At any cost, it doesnt matter we just need to get it down to 4 months. Any help at all would be greatly appreciated.

I assure you, it will take more than you are willing to do and pay to fight it.  I just went through that with my brother.  The entire matter was entrapment, he lost his license for almost two years.  If her attorney left stuff on her record that he was supposed to clear up, tell him to finish the job or take him to the county bar association and ask for a fee arbitration and get her money back that he did not earn.

      California is coming down hard on DUIs, it would probably take more than two months to get a court date.  


  2. 6 months is nothing compared to a family who may have lost a loved one FOREVER b/c your gf wasnt mature enough NOT to drink & drive

She made her bed now she must lie in it.  A person like your g/f KILLED my INNOCENT brother by drinking and driving!!  She is lucky she didn't kill anyone!  The person that killed my brother is in jail where he belongs. He's been in there for 6 years and not getting out for another year.  You will not get ANY sympathy from me whatsoever!  Tell your girl to deal with the consequences she brought on herself.  Oh, btw, he was a first time offender!  No one likes it when ppl cry about the consequences, they brought on their own.

  5. She needs to appeal to the Department of Motor Vehicles for a shorter suspension.

    There is a mistake in her suspension, California law says she gets a 4 month suspension if she did not refuse to take the test, and if she did refuse it is 1 year suspension.

    The suspension is an administrative function of the department of motor vehicles, and there is nothing that the attorney could have done to prevent them from making what appears to be a mistake.  The COURT did not suspend her license.

Although I have very little sympathy for your very selfish and irresponsible girlfriend, who honestly does not deserve to be driving, she does deserve a lawyer who appropriately defends her.  If the lawyer she hired failed to do his job, you should contact the California Bar Association for more information on the next steps you should take, and what your rights are.

  7. If she hadn't drunk and drove in the first place, she wouldn't have lost her license. The penalty should be much harsher to teach these people a lesson.
