claim made for compensation it was on dads death certificate he died from the miners decease claim is settled and payment has gone to 1 sibling who is now claiming it is her,s can she really do this as there are another 5 siblings who were told they would all get a share

  1. if there is no will then it is usually split between the surviving children.

If there is documentary evidence, e.g. a will, that says the compensation must be shared, the sibling who received the payment must share it, if it was only a verbal agreement, or wish declared by your father, then I think it would be very difficult to prove, especially if the sibling who received the payment is the eldest. You really do need to get legal advice !

  3. 1- I am sure you have a valid question.. however, it is completely unlikely to be seen by many persons with legal knowledge, who normally do not review questions in the genealogy area.

    2- The law is different depending on where you live. If you repost the question in law/ethics area, you would be better off to include where you live.

    3- Do not forget.. yahoo answers is open to any opinion, not just lawyers. In serious matters, you cannot rely on what an amateur tells you.
