Question:

8 hour work day with no breaks.?

My employer, a decent sized company, does not give any of it's employees any breaks. We all work a minimum of uninterrupted 8 hour shift. That's right, no breaks, not even a 15 minute break.

It's a pretty fast paced environment. We only get to go to the bathroom or eat lunch/dinner if we have the time, which is rare.

Is this acceptable by law?

  1. By law if you're working over 6 hours in a single shift you are required to have two 15-minute breaks and one half hour break. I work for a small business as well in an office and get two 15-minute breaks and an hour for lunch.

    Okay, did a little research after posting and found this:

    The Fair Labor Standards Act (FLSA) indicates that technically there is no federal labor law requiring employers to give you a break. And worse, only 19 states have a law in place to protect employees. It is unfair but most employers will give you a break. Hopefully you're in one of the states that requires employers to give their employees time off for a break.


  2. it is illegal to work longer than 5 hours without a break where i work.  you should check with your local Department of Labor or check out the link for the US Dept of Labor. If you can prove you are not getting breaks or even lunch somedays- i would definately take action.

  3. Call the Dept of Labor in your state.  Breaks are mandatory.
