Question:

8 years ago a man went to jail for holding a gun to my head, and trying to kill me

He was charged w/ 14 felonies, and opted for a plea bargain. the DA let us choose, and we (there were 2 girls in the car w/ me) agreed on 8 years. 6 of straight jail time, and 2 of the CREST program. I was wondering if there will still be a restraining order when he gets out in a few months, or if i will have to fend for myself. I know its unlikely but i am afraid he will want to retaliate for me sending him away; i am the only one he knows out of the 3 of us, and he sent me letters from jail threatening me, and sent someone to my house with the same intention. I am a little nervous, My question is, is there still a restraining order in place, and how long will it be good for?

  1. Save those letters and make copies for yourself and for the DA. That should be enough for your order of protection.  


  2. If  he is paroled show the parole officer the letters and ask him to place a condition of parole that he have no contact with you or risk being violated, it's very easy.

If he sent threatening letters I would I would bring them to the attention of the prison immediatley.  Then I would file a police report.  I believe that what he is doing is another crime.  He can be prosecuted before he gets out.  You can get a restrainging order, but a criminal doesn't care about them and if he wants to come after you he will, regardless of a restraining order.  It would be unlikely normally, but if he is sending you letters and someone has come to your house, then I would be concerned.  You must tell the prison and file a police report.

  4. *clears throat* as a gun owner may I make a suggestion? Buy either a shot gun or a nice little postol that'll be able to stop him before he get you! Gubs can come in very habdy in these types of situations. I would think that if he sent letters and people over there, that a restraining order would stop him, Besides, what is that besides a piece of paper? I would also ask our local law enfocement to come by your house and check up on you evernow and then. Ask your neighbors if they can keep an eye out for this guy. If they say they've seen him, let the cops know and ask them to stakeout a few nights to see if he comes back...

  5. If he sent you any letters threatening you, you need to take those to the prosecutor and let him file a new case against him for witness tampering and/or the threats.

  6. Show those letters to the cops and you will be able to get a restraining order from the judge. Act now before it is too late.

  7. it is not unlikely, he will try to come after you. trust me especially if he is sending people to your house and writing threatening letters. he knows where you live and he might want revenge. there is still a restraining order in place but you should check with authorities for the experation and tell them you want to extend it.
