Question:

A boy jumps on sons back ,hits him head,son gets him on the ground/held him down by twisting arm/broke/fault?

my son and girl yelling at each other, a boy jumps on my son back and starts punching him in the head, my son gets him off by getting him to the ground and was twisting his arm to hold him down . he broke the boys arm, he didn't relealize it only takes 7 pounds of pressure to brake a persons arm. who should be charged ??

  3. depends on the age of your son. It does sound like self defense and it sounds like our son didn't have much of a choice. there is a possibility he could still be charged but it sounds to me like it was started by the other boy.

    Why was your son yelling at a girl? It also sounds like the other boy was defending the girl from your son.

  4. Both.  They BOTH engaged in physical violence, so they should BOTH be charged equally.  

    My brother was attacjed at school while in highschool.  He did nothing, he sat there and tooj it until the other boy was dragged off by the adults.  THAT is the only way you can escape a charge yourself, if you do not fight bacj even if you're being attacjed.  

    Both resorted to physical violence, BOTH need to be arrested and charged.

  5. where were they?  if the boy came over to your house or your property to start a fight with your son, then he could be charged with trespassing, disturbing the peace, harassment, and assault and battery.  you would probably have to file these charges.  if they were at the other boys house or property, they could possibly do the same to your son, but on the other hand if a witness says that the boy hit your son first and your son was only defending himself, no matter where they were, it will be the other boy's fault and you or your son will not have to pay medical expenses or any compensation.  if they were in a public place they will probably both get a disturbing the peace violation, but if a witness steps up and says that the other boy hit your son first, it will be self defense, but if not, he might be charged.  and if it's just his word against your son's, no witnesses, and in a public place, then your son could possibly be charged even if he was just defending himself.

  9. first of all how old are these kids? and if this was self-defence then it should be the boy who started it.
