A Canadian woman married to an American man have a child in the USA in the 1930's. The woman probably became an American citizen at some point during her marriage. Is the child a Canadian citizen? The laws have changed many times since then, and there's very little information about the citizenship status of elderly people.

  2. If a child is physically born in the USA, then the baby is a US citizen regardless if the mother and or father is an alien.

  3. Hi, let me try to help.  I am an American and my child was born in Canada a few years ago.  I have a little bit of experience with this.

    The child has a right to Canadian citizenship being that one parent was a Canadian citizen at the time of the birth.

    This website will tell you how to go about claiming your Canadian citizenship in this case.  You will need to apply for a Certificate of Citizenship in your case.  I am assuming that the mother never registered the birth with the Canadian Consulate.  You will need the birth certificate of the child and documentation proving that the mother listed on the child's birth certificate was a Canadian citizen at the time of the birth.

    You will need to click on the link for the application for Certificate of Citizenship and then go the application for a person residing outside of Canada.  Read the guide to the application and see if you can provide the correct documents.

    I realize the child was born prior to 1947, if you read the guide on the application from outside of the country you will see that one of the boxes is for children born outside of Canada prior to 1947.
