  1. No you are not at fault. If you have a police report it will help and if they have the other drivers information and he admitted it then his insurance will cover your car. If the other driver blames you and there is no physical evidence to show he caused it and no witnesses then it is your word against his. If you have no poilce report tell the truth they will still fix your car but they may also raise your rates. They have no way of knowing if you are telling the truth either.


  2. Tell your insurance what you told the cops when you filed the police report.

    You FILED a police report, right?  

  3. if you can catch the other driver then i think that they would be at fault but if its just you then tell insurance what happened
