A company used a photo of my child without our permission in a print ad, is there anything we can do about it?

A photo of my child was discovered to be used in a print ad by a major company and no permission to do so or contract was agreed upon. I'm wondering what if at all, is there anything we as parents can do about this? I feel violated as I was unaware of this publication nor did I or the mother agree to any conditions or agree that her photo could be used.

  1. What's the big deal? It's a bloody photo!

    Legal advise? trace out the original company who took the photo and if you signed ANYTHING, check it's disclaimers or clauses.

    I would also contact the company who displayed your lovely child all over the world for countless eyes to see.

  3. For one, you did not indicate how this "major company" was able to get this picture.  Did they take the picture (I.e. you paid for pictures to be taken)?  If so, then they own this picture and can post it in an ad.  

    If they just randomly was taking pictures without permission and then posted it in an ad, then they MAY get into a little trouble.

    Trust me, you are NOT going to be getting any money.  So, if you want to sue for money and greed, you are just wasting your time, money, and the courts time!

  4. do your homework..check in a law library..investigate yourself..make police reports..see if you can speak for advertising department

  5. get an ambulance chaser and sue!
