Question:

A cop almost hit me, what to do in this possible situation?

I was going about 5mph over the speed limit as a red mustang passes me going about 5mph faster than me. As the mustang was probably 2 seconds in front of me, an unmarked car pulls out of a gas station and I thought it was a regular car (no flashing lights) and I thought he was gunna turn right into the right lane. As the cop was about half way into the right lane, the cop puts on his lights, and nearly pulls in front of me in the left lane. Being in the Chicago area (Naperville) with the frigid temps and slick roads, I slid a bit as I slammed on my brakes. This was right before an intersection w/ a green light and the mustang was in the left turn lane making a left turn. In that scenario, would the cop have found a way to put me at fault, or would it have clearly been his fault?

oh by the way, i'm 18 (male) w/ no accidents or tickets if that would have any indications of being my fault

  1. What to do in your situation, nothing but if he would have hit you and I have seen this before, you need to call 911 and get another police officer on the seen for your protection.


  2. I see what you mean. I dbt the officer would take the blame unless he had no way out of it. THATS just my opinion though. >?<

  3. wow, a bad situation to be in, let me tell you what happened to me when a cop rear ended me while dialing on his cell phone...

    I had just exited the intertsate and came to a light, it was two lanes going forward across 5th ave in St.Pete Florida, there was a car in front of me and several to my right...The light turned green and traffic began to move across 5th ave, after the car in front of me shot across the intersection I notice a police car slowly going through the red light with his lights on, requesting the right of way, I had only just moved about 8-10 feet and stopped to yield to the cop... another cop in his personal jeep grand wagoneer rear ended me brutally...he had been coming down the ramp, saw the green light, assumed traffic would keep moving and was messing with his cell phone and rear ended me without even hitting his brakes...

    The cop going through the intersection stopped and the cop behind me flashed his badge and all of a sudden the cop screamed at me and asked me why I stopped....

    I said to yield the right of way to you...., he said you don't stop, you go through and pull over if you have to...My question then is, if your weren't requesting traffic to yield to you and I should have proceeded through the intersection, why not just wait for the light to change and proceed when the opposing traffic had stopped, or wait till the traffic was done crossing and then go through against the light?....I posed this point and they became angry then...hmmm 12 cops at a simple traffic crash with no emergency injuries?...Thats about what showed up...Turns out they were responding to an assist call for a drug car stop, that caused another crash on the other side of the interstate...

    All in the middle of the day and obviosly not critical enough to justify causing 2 crashes over it.

    They tried to figure a way to hang it on me but hey couldn't and ended up not citing anybody...

    Hmmm I wonder if I would have been cited if I were him?..... Hmmmm

    In your case... it would depend on what picture the report they concocted against you painted , and rest assured the report would be written to make it appear to be your fault... Your only hope would be credible witnesses and or maybe the hope that a traffic camera caught everything and you were allowed to use this tape in your defense, my guess is any such tape would disappear should it prove the police at fault....

    Wow , no good could come of that I assure you...

    Ina  situtaion like that I would immediatly get names and numbers of anyone who may have witnessed the accident, take pictures, note everything you can, they will do the same and they will have other cops on their side...

  4. If it didn't happen, why worry about it? If something had occured the circumstances would have dictated fault.

  5. You are going to find that c**p like this happens all the time. Hopefully you will learn quickly and not type a long boring hypothetical question every time it does. You need to learn to get you, your car, and your passengers to the destination undamaged. That will mean you will encounter situations from time to time that will require you to react in such a way as to avoid a collision. Life is not the picnic that your parents and Barney set you up to expect.

  7. You were speeding.  You would be cited.  Previous driving history has no bearing.  Sorry.
