A debt collection agency mistakenly placed a legal judgment on my credit report. I have a son with the same name that used to live at the same address and the judgment properly belongs on his credit, not mine. What can I do to fix this?

What law(s) have they broken?

What is my best recourse or course of action at this point? Please do not tell me to contact an attorney, because I intend to, but right now I am just trying to educate myself on the matter.

  1. This actually happens more than people think.

    You will need to dispute the judgment, in writing, to all 3 credit agencies (TransUnion, Experian and Equifax). I would "cc" the collection agency as well. Provide them with all pertinent info ie ss# etc. They have 30 days from the day they receive the dispute to get back to you. If after 30 days they don't get back to you, they have to take it off your report and you can request a rescore.

    You really don't have to see an attorney about this, unless you really want to pay someone do write 3 letters for you.


  2. Well I'd say that your friend is going ot have to proof that he's who he says he is...cause more than likely you'll need to help determine who you are.. can't hurt right... Good luck !!

  3. ASK THE COLLECTORS WHAT SSN THEY USED TO MAKE THE REPORT?

  4. contact the credit bureau agency they will investigate and remove it if it is incorrect
