  1. If the DA can show intent. Otherwise it is more likely a case for malpractice.


  2. You will have to prove he intentionally did it.  If you cannot, then it was just an accident and a matter for malpractice suit, not criminal.

  3. Yeah if the doctor did that you can sue them, as long as there is records of it.

  5. give your attorney all of your proof and documentation that shows the doctor is guilty of malpractice and he will file a case.

  6. Sounds more like a malpractice situation. In order for a criminal prosecution, you must have criminal intent. If it can be proven that the doctor maliciously and with intent to kill gave your wife the drugs then yes. If it cannot be proven then your recourse is civil and filing complaints through the AMA.
