A friend driving my car and he hit someone! hit and run mail came. is it my fault???

I got out of my car and talked to the lady and she told me to go. so I left! I recieved a hit and run notice and I need to go to court! I think its not my fault and its the driver's!

  1. It's not your fault. It is, as you said, the driver's. If the lady you hit witnessed you exiting the passenger's side of the car, or someone else did, you could use that as evidence against the crime. If your friend is really your friend, he will testify against the lady.

Being a police officer I can tell you that anytime you are involved in a traffic accident, by law you have to exchange information.  Name, address, vehicle information, and insurance.  Why would anyone leave the scene if you had damage to your car?  If there was no damage to your car and none to the other car, the vehicle code says that it is not a traffic accident.  There has to be damage.  If a friend left the scene and you got the notice from court,  contact the investigating officer and give him/her the friends information who drove the car.  They won't prosecute you, however, your insurance company will probably drop you for loaning your car to someone not on your policy.  Also, the other party involved in the traffic accident has to identify you as the other driver before the court will convict.

  3. If you allowed someone to use your car, the friend would be covered under your insurance.  If he hit someone, and you left the scene without reporting it to the police just because the other driver told you to go, it becomes your word against the other driver.

    You have no choice but to go to court, and tell the court what you have told us.  If you discuss it with your insurance agent, he will probably get you some representation and advice.
