A guy pulled a gun on me at my front door of my apartment. i want out of my lease how do i do it?

i have a wife and a baby do in 4 weeks i don't want my child to live in this area we moved up to lexington ky from fl what can i do to get out of my lease the guy that pulled the gun got arrested and his girl friend still lives below me why an't she evicted either my wife and i just want out but are landlord says no.

  1. He pretty much has you.  Usually, you will have to play 2 months rent in order to break a lease.  Sometimes, the security deposit may help to absorb some of this hit, given that the place is in good condition when you leave.  Or, if you find someone to take over the lease.  If you still don't find a suitable solution, you can always make it hard on the landlord.  Call and complain about EVERYTHING.  Water isn't hot, windows are sticking, heat doesn't work properly, electrical outlets don't look safe, toilet leaks, stopped up drain, etc...Make him want you to leave...Good luck to you.

  4. the landlord tenent act says you must be protected at all times among other things. they have a right to "remedy" the situation by moving you to a nother appartment there however. I would explain this right to the landlord and let them know they HAVE to remedy this or you will be putting your moneyinto the escrow account at the court house for rent and filling a complaint with the courts. they can't sue you for non payment of rent if it is in escrow at the courthouse and you can start a suit to get out due to the protection of the landlord tenent act. if you feel like its over your head get an attorney.

Then you have to go to court and file a complaint stating that the place where you live is no longer safe, which you do have proof and ask a judge to anulate the lease whether your landlord likes it or not. You should also visit a lawyer to make sure what statutes support you and protect from any counter part from the landlord.

  6. Check your lease, the best you can for any clauses in there about any 'outs'. Go to your Town/City Hall and ask for a copy of the Housing Code. Go through your apartment (if you know these things) and find faults. If you don't, you could hire an inspector. Once the owner is out of code, he has to fix it in a period of time (which usually won't happen) or you're out of the lease. He will want to get you out as soon as you start finding things. And there are always things.

  7. Bring your lease agreement to an attorney - look in your yellow pages, some attorney's will give a free consultation.  Often times they will even tell you if you just need to file paperwork, and if there's a fee for anything it's usually not too much.  I don't blame you for not wanting to stay there!    

  8. are you poor?  if so,maybe try legal aid.  take your lease and have them look at it.  they can advise you better than the knuckleheads on this site.  like the answer above... more than likely your lease prohibits subleasing or assignment.  that's exactly why you need to have a lawyer advise you.  or the guy below... "anulate"?  that's not even a word.

    EDIT:  Ok... here's the Landlord Tenant Act for Kentucky.  You probably don't have an out based upon your neighbor's psycho boyfriend, but look through and see if there is any other violation(s) that you could use as grounds for termination...   10. make a police report break the lease and when you go to court tell them why you broke the lease and how your apartment didn't give you any other options for you and your family to be safe.

  11. You can try to get someone to take over your lease.  Other than that, you're unfortunately stuck paying until the end of the lease.
