A jail warden point a gun to my brother, point it on his chest, what case should we file? Where to file it?

P.S. IT HAPPENED OUTSIDE THE JAIL, THE WARDEN POINT A GUN TO MY BROTHER IN THE JEEPNEY TERMINAL..MY BROTHER IS A BARKER IN THE JEEPNEY TERMINAL. THE WARDEN QUESTIONS THE ADDITIONAL FARE AND WHEN MY BROTHER IS ABOUT TO SHOW THE LTO'S TARIFF, THE WARDEN GOT FURIOUS AND POINTED A GUN TO MY BROTHER.

First, your brother have to file a blotter with the nearest Police Station where the place of incident is in its area of responsibility.  Tell the police that you want to file a case against the suspect and that you want to charge him with Grave Treat with a handgun, which is a criminal case.  No longer than a week.  Justice delayed is justice denied.  The longer time it took for you to file the little the chances you will win.  File a similar case with the Department of Corrections and Penology, and Department of Justice for administrative case.

Your brother should act fearful of his life and that he fear for his family safety and it is affecting him and his work.  Go to the Public Attorneys Office in your City Hall and ask for Legal Help.

Were there any witnesses? Your brother could file a police blotter and make sure that the witness will be with him then.

The thing is, is the terminal where your brother barks (is that the proper verb for it?!=P) a legal one?If in case its an illegal terminal, your brother might be liable for a different case and those that are operating the terminal.

I couldn't agree more with e=mc2. People don't need barkers. They are just adding noise pollution and take a lot of money to the poor driver. See how many jeepneys are there on the road and how many times do they make a turn? If there was a million turn, barker could make a lot then huh?

Well I feel bad that your brother was maltreated. We all know that what that police did was not good.. definitely beyond the law. We will also appreciate it if you do not write in all caps because If you know email or text etiquette writing in all caps means you are angry and shouting. Try to google it.

About you asking if you can file a case, yes you can.. but be prepared to have a big amount of money for the lawyers fee etc etc... Also know that these people could make your life miserable as government has no control of bad police at all.. sad but its true. I'd say rather than spend a fortune getting a good lawyer just give it to your brother so he can save it and stop being a nuisance.

Better just forget about it.  You will stir up a hornets nest if you try to go after that warden.  They will stick together and turn on you.  If everyone who abused their authority were jailed, there would be no one left to control the REALLY bad guys.  He just had a temporary case of "whiskey-brave".  At least he didn't shoot.  Try to forgive him that minor infraction.  If he is always doing this kind of behavior, someone will kill him soon enough.

First of all you need to learn VERBS and TENSES... because the court will laugh at anyone who can only take in PRESENT TENSE... it takes a better command of english than you seem to have to take a complaint to the court.

this is a clear case of grave threat and abuse of authority. your bro should file complaints both with the barangay captain and at the police station immediately. bring witnesses.

realistically, nothing might happen. they might ask the warden for an apology which he may or may not give. because he knows your bro cannot afford a lawyer.

his best best is to convince the jeepney association to take his side and file a formal letter of complaint to the bjmp.

Tell your brother not to do anything...

For starters we do not need Jeepney barkers. Jeepney barkers are loud and rude.

We all know how to read or ask the driver. Your brother needs to find honest work, and quit attaching himself to businesses where his "services" are not wanted.

Do a little survey among people that you know. Ask a few people who drive jeepneys if a barker is needed.

Ask them if they like paying the barkers at every jeepney stop.

Ask your friends if they would rather have jeepney stops with barkers, or without barkers.

You will find in your survey that no one wants or likes having parasitic jeepney and taxi barkers around.

I would love to pull a gun on all of the jeepney barkers too!!!

I wish they would stay away from me and stop running up the costs of transportation services that we use.

you got witnesses? go to RMN (Radio Mindanao Network) and consult the idol of many filipinos RAFFY TULFO and NINA TADURAN who has on-air AM radio during weekdays 2 pm to 4 pm.Their radio program is monitored in 558 AM radio. They really get pissed off to abusive authorities. They might then pass you to ATTY AGA  if you wish to file complains. I think that would be a criminal offense. Something like GRAVE THREAT, even without any words uttered. Even if it was a toy or unloaded pistol as long as it was pointed.

i think "ako si dude" suggested a much better option, just be lenient  towards the incident and avoid things to escalates, but you still better file a blotter in your local barangay office and the local police precinct . Unless you are ready to gamble your life, then have him serve his term. He may have "padrinos", but he may also have secret enemies who would want him jailed for his unruly behavior.He may have met his match. If he got a "giant" to back him up, go get your own "giants" thru the media and CHR,VACC etc.
