A lawyer to sign over parental rights???????????

To make a long story short, my child's father hit me in my face because of some dumb assumption that he made up. He did this in front of my child who is two. He continued to blow my phone up with calls and textes and then got mad when i didnt respond so he said he wanted to sign over his rights. Then he says that he wants to be in my son's life. I said okay as long as you dont plan on skipping out on him again cause that will be the last. He asked me to bring the baby to his house and I said that i was tired, even though he has a car.Then he textes me sayin that he wants out and he doesn't want to deal with my attitude cause i didnt want to bring the baby to his house. So I'm all for him signing over his rights cause this is getting ridiculous and he settin a bad example for my child. I tried to give this man the benefit of the doubt and he has not done anything for my child because he does things like that to try to get back at me. I dont feel that he should be able to run away from his responsibilities as a man cause no matter what he signs, bi logically my child will always be his. College is not cheap and we are in the middle of a recession. So therefore i want him to take me to court so maybe he can sign over his rights and still have to pay child support. And let the truth be told I dont even think that he would leave after he has signed them over. Cause he's only doin it to get out of paying. And he would like for his family so change their ties with my baby as well. Would I need a lawyer for this? Or any suggestions? And please don't want my time or yours with ignorant answers!!!

Depending upon what state you live in if he signs over all parental rights he may not have to pay you child support.  The only state I know that still requires a non-custodial parent who has signed away all parental rights to pay child support is California and that is only until the child's mother remarries.  In order for him to sign away all parental rights he has to go to court anyway and going to court is no guarantee that you will get child support.  If you want child support you need to FILE for child support and not have him sign away all rights.  If you want him to sign away all rights you will be on your own.  


  2. What country do you live in?  And are you talking about parental rights or custodial/visitation rights?  They are very different things and are treated very differently by the court.
