A man puts a gun to your head...(read on)?

A man puts a gun to your head, he tells you he is going to kill you, you successfully disarm him and manage to grab the gun and run away, he doesn't give chase to you.

Could he take you to court for theft of his gun?

Not if you take it to the police and explain how you came to have position of it.

Chances are, however, that someone who made threats to kill you and held said gun to your head won't report a stolen gun...

he probably stole it.and if that happened he would be arrested for attempted armed robbery on the spot.so i would say keep it!

You don't say why he put the gun to your head or whether he had a legitimate reason for doing so. For this example, we will assume that he didn't have one.

He could sign a complaint for theft.

Your defense would be that you acted in self defense and you turned the gun over to police as soon as possible. If you didn't turn it over immediately, you are in possession of a stolen firearm (federal felony), and possibly, depending on your state's laws, illegal possession of a weapon.

The police would take the gun into posession as evidence in the crime committed against you, when it was reported.  So, the answer is no.

Call the police and report the incident and turn over the gun to the police.  Who knows what crimes have been committed with the weapon.  You certainly do not want to be connected to other offenses.

There is no theft here.  It is self defense of an attempted murder or assault with a deadly weapon.

most gun threats involve illegal guns so how do you lay claim to something that doesn't belong to you.

On second thoughts why would you be carrying it around after the trouble is over...?
