  1. You can only carry on driving it if your previous MOT still has time left to run. If it's expired then the only place you can drive it is from the MOT garage it failed at to either another garage for repairs or home. You can't simply carry on using the car if it doesn't have a valid MOT (regardless of whether or not it's booked in for a re-test in the near future) and if this mechanic has told you otherwise he's talking out of his a*se.

  2. You are required to have your car mot`d every 12 months however you can take it in for its mot up to one month early so although your car may have failed its mot for the coming year  it might still be covered by last years mot if it has not ran out yet.

Your car should be roadworthy at all times however many cars fail their mot and owners are allowed to drive their cars home where they can repair any faults before a retest is done. This is only allowed when the car has non critical faults as some faults are more serious than others like your brakes are more important than an indicator and as your car is booked in tomorrow you will be ok.

You are only allowed to drive a car with no mot to a testing station if prebooked.

  3. I guess you should be leaving it with him till it's sorted tomorrow. I don't think you would get in too much trouble for driving home tonight as long as you're only gonna drive it back tomorrow for the service/repair.

If the MOT has run out though, any driving of the car on the public roads is illegal.
