A mother and her children come in for counseling because of a divorce. ?

The father has had contact with the therapist by phone about the children. He has said he would come in for a session, but did not follow through with attendance. Two months later the father has the mother in court for custody issues. A guardian ad litem (a lawyer for the children) is appointed and contacts the therapist for their opinion on the mother and father. The father never came in and signed a release of information. What does the therapist do?

Who has legal custody of the children? Not physical, but legal (who makes decisions about children...etc)? Because I believe only that parent can authorize a release of information about the children.
