Question:

A person hit me and he was found at fault by the cop. What to do?

He was in front of me in a jug handle in New Jersey. He steered to go into the middle lane coming out of the jug handle leaving PLENTY of room for cars to pass him on the right as he was no longer in the right lane. So I went ahead and when he discovered he wasn't going to get in he turned to go back into the right lane and his tire hit the back side of my car leaving some damage. The cop found him at fault but didn't write him a ticket. I went to four different Auto Body shops for estimates and now he wants me to go to his friend's body shop(which I do not trust after meeting him) and PAY for half the damage. He's trying to say that I'm somewhat at fault in the accident because he says he was still in the right lane. I want to go through insurance but I don't think I should have to pay anything as I was not at fault.

What should I do?

    Your insurance adjuster will deal with his insurance company.

    If this guy wants to save his safe driving discount, he still can do it by paying the insurance company the money they paid out to you.

    That way, you do not have to deal with him or put up with is antics.

    His issues are not your problem nor should they become your problem. He's caused you enough grief.

    Make sure you have a good statement and most important two things:

    Photographs and names of any independant witnesses.

  4. All you need to do is call your insurance company and they will do all the work for you and they will also contact the police officer plus do not take it to his friends body shop, they will cut corners to save money..

  6. First contact your insurance company and let them do the leg work. That's what you pay them for. If that doesn't work contact his insurance company and tell them you want your car fixed. If you don't have the name of his insurance co. contact the police and  ask for it or get a copy of the crash report, it should have his insurance, name, address phone number and description of his car and a diagram of the crash scene and an explanation as to what happened to cause the crash. Now contact his insurance co. Good luck.
