Question:

A roomie leaves and wants his portion of the security deposit back- other roommates are staying. who pays who

I have a roomie who left suddenly but somewhat amicably. He did not pay his last months rent so we "took it out" of his secuirty deposit. After he leaving, he wants the remainder of his security deposit back, but that comes from me and the other room mate who is still staying's pocket- do we have to pay out of our own pockets, ask the land lord for his portion back to give to him, or does he have to "eat it" until the remainder of the roommates leave. (myself and 1 other.)

  1. If he didn't pay his last months rent I don't think you owe him anything.


  2. Of course, it comes out of YOUR pocket to give him his remainder of the security deposit, minus his share of the rent he did not pay which he shoul.d have paid. Did your roommate .give proper notice, 30 days? And pay rent for all of the days he was there? The landlord does not change the security deposit he charges just because your roommate moved out. All that means is the security deposit is divided among those still living there. It sounds like there were 3 of you, with each putting up a third, correct? When the 1 roomie moved out, he should get his third back, from the two of you remaining, which now means that if you both move out, then each of you two remaining gets half the security deposit returned from the landlord when you finally DO move out..

    Now; IF he gave you all thirty days notice that he was moving ; then you all had time to try to find someone else  ..BUT; if not .... He wouldn't get a dime back from me...

    Was his deposit more than his rent owed?

    If so, you guys should give him the leftover monies, regardless of whose pocket it comes out of.

  5. You do not owe him ANYTHING BECAUSE HE DID NOT PAY HIS LAST MONTH'S RENT AND TELL HIM THAT. You were right in taking it out of his security deposit...do not worry, you are in the RIGHT!!!

  6. usually the way it works with roommates is that if one leaves they need to find someone to fill their spot... otherwise the remaining roomies end up paying more for their rent and having to find another roommate, etc. 1. broke his lease by leaving early. 2. didn't give proper notice. 3. didn't pay last months rent. I say you don't owe him anything.

  7. Nobody has to pay him anything!!!

    NO secruity deposit is paid back untill all tenants have vacated.

    He will have to wait to settle that up with you after you all move out.

  8. If the three of you signed a lease, he is responsible for his share of the rent. It doesn't matter that he doesn't live there anymore. You may be able to take him to small claims court for his unpaid share of the rent. He would be better of to just let you keep the deposit.
