A stranger man bit my wife in front of my eyes ,i had to protect her now i have to go to court what can i do ?

we own an Italian pizzeria and our next door neighbors have got an Indian take away ,there is this man who works for that take away and he parks his car always in our parking space but he is not allowed to do this so i have told him many times not to park his car there !and he didn't listen to me , until two days ago, i told him again not to do this because we need this parking space for our drivers in the shop and again he completely ignored me so i decided to use one of those rubber road traffic cones that separated the gaps between parking spaces , and this man saw that and he became very aggressive about it and took the cone and came in the shop and he threw it at me ,then he said nobody can stop me .! He did this in front of my customers so I was very upset and I wanted to go and talk to him and tell him that what he did was wrong but my wife stopped me and she told me that it's better if a woman handles this ,so she said I'll go and tell him not to do this so she went there and talked to the guy I was at that time in the shop waiting for her to come back but all of a sudden i heard my wife screaming for help I run as fastest as I could and when I arrived at the scene the man was hurting my wife and he was twisting my wife's hands with his both hands she was in lots of pain and crying her life was in danger he wanted to brake my sweethearts hands so I pushed him and punched him then he run away with his car ,I called the police ,when the police arrived the also came with an ambulance and took my wife to hospital and they took me to the police station for and interview,after the interview police gave me a letter to attend the court ! now i know that my wife told me that she said in a very polite way to the man that he couldn't park his car there but the man said nothing to her and he just grabbed my wife's hands and he twisted her arms and i witnessed how he was hurting my wife this man is very aggressive we have sued him and he has also given interview to police and he is suing me because i punched him too ,at the moment i am very confused and i just need some advise from people around me will you please help us ?

Any advise would be great they just want to know how to protect themselves in court . Thanks

  1. You need a solicitor and you need it quickly.

    Only they are going to be able to help you through the maze that is going to court and sorting out such a legal wrangle.

    No other way I am afraid.


  2. You are within your rights to protect your wife, it is self defense.  If you have witnesses the this would be good.  Also your wife will have to go to court to say what this man did to her.  The police will be prosecuting him and your wife will have hospital records and photos of her wounds.

    I wouldn`t worry about him suing you, it is mitigating circumstances and you should be fine.

  3. This man came into your business and caused a scene over your entitled parking space. He then assaulted your wife, obviously to the point where she needed medical attention. The man needs some anger management, and some hefty fines to curb his anger. Contact an attorney, and I am sure he/she will put your mind at ease. I would find one who specializes in criminal assault. The Yellow pages either here on the internet, or in your local phone book should be able to help you find one. Depending on where you live, you may even be able to force him to pay your attorney fees, medical bills, and lost wages due to your wifes injuries, mental and physical. If it all happened as you say, it is clear cut self defense of your wife.  

  4. Don't go to court without a good  solicitor....tell the story of what happened just as you explained it here.

  5. Remember what you told the police and what you saw.

    You saw the man physically man-hanlding your wife,

    He was restraining and twisting your wife's hands and she was crying

    and screaming for help

    You protected your wife, by pushing him away, and he then got into an aggressive stance and you defended yourself by hitting him,

    Nothing else to say...

    Put a sign up on the wall for that parking space

               "RESEVERED FOR THE ITIALIAN PIZZERIA"

             Voilators will be towed by the car owners expense.

  7. Well, The man who had assaulted your wife, in defence for him trying to sue you is the " good samaritan law"

    Good Samaritan laws (acts) in the United States and Canada are laws/acts protecting from blame those who choose to aid others who are injured or ill.

    In some aspect it was self-defence,for your wife, You saw your Wife, being assaulted by a man, and clearly she was in pain and needed your help, so you did what you had to do to protect your wife.

    You were obliged to come to the rescue of someone in distress, under the good samaritan law.

    I'd suggest you get a lawyer to state your case in court and also to give you some more advise.

  9. First off you started out wrong you should have called the cops when he kept parking there. Now you need to get as many witnesses as you can and get a good lawyer. Get some of your customers to write out some statements. If you have regulars this should be no problem.

  10. I would say get get an atty. seems to me you have a self defense issue going on. As far as the parking space thing get a private or reserved sign that says for owner only or something of that nature and make sure it says unathorized vec. will be towed at owners expense that way if the guy continues to park there you can call the police and have him given a ticket and have his car towed..
