Question:

A towtruck crashed my car..What now?

My car had expired tags. A towtruck came to haul my car from my house. During the process their brakes failed and the towtruck with my car attached went down a hill and hit a cop car. My car is seriously damaged. What should come of this? They should give me a check for bluebook value right? I do have insurance under my parents coverage.

  1. Yeah, What bad luck.

    Just get yourself a copy of the police report. Towing Companies are usually required to have coverage for this  sort of loss. Since the driver hit a cop car, I'm sure a police report was made. The tow truck drivers insurance information should be on the report, get the policy number, then you can call and file a claim with them.

    If you have full coverage under your parents policy you could claim with them and they will subrogate from the Tow truck companies  insurer.

  2. You file a claim against their liability coverage.  Their insurance company will complete an investigation.  If they accept liability, they will offer you the Actual Cash Value for our vehicle, not the Blue Book value.  ACV = Replacement minus depriciation.  

    Any old damage will be deducted from the ACV.

  3. Wow. isn't it ironic? The tow truck should be liable for any damages that occurs due to it's equipment failling. Review their policies.
