Abandoned Property?

I own a home and have a large rear yard. About a year ago I allowed a young person to park a truck with transmission problems until he could get it fixed. He has made no attempt to fix the vehcicle and I have asked on several occasions to get it removed from my property. I sent him a letter stating that I wanted 10.00 per day rent for storing his truck and if he did not pay or remove the truck with in 30 days I would have it hauled away for scrap.

If he doesn't comply can I legally scrap his truck? I live in Massachusetts.

  1. I would see if you can do that first by talking to a lawyer or get the police involved if this is really bothering you.

  3. yes you can but you might have to post an ad or something or attempt to find him first.But there are laws pertaining to abandoned property.With most stuff it is like 72 hours and it is considered abandoned.

  4. I live in British Columbia, so practices are probably different in details, but I'm going through the same kind of thing.

    In this case, the vehicle is a baby-blue '87 Mustang, low mileage, beautiful body, works impeccably, sound system you wouldn't believe ....

    To make a long story short, I lent a onetime friend money to buy it and shine it up. Not cheap. 3 years ago, he ****ed off to Alberta, and no one has seen hide or hair of him since.

    It's been sitting in my garage since, and it's time to do something about it.

    So I called our local Mounties, who told me to get in touch with Motor Vehicles Registration, who have a routine for this kind of situation.

    So I started by writing a letter to Motor Vehicles, describing the circumstances, Vehicle Identification Number, etc.

    The next step will be sending registered letter to the current "owner", at his last known address, (which I know to be obsolete.) When the letter is returned, I may then apply to have it registered in my name.

    I haven't decided about driving it and/or selling it (wonder what it's worth?) Maybe I should post a Question ....

  7. uh no i think. you can't take him to small claims either because you would need a writen contract. ask the PD they would know.

  8. Unless he agrees to pay the daily fee, you won't be able to collect it, because you agreed to allow him to park the vehicle without charge. In other words, you can't amend the agreement on your own.

    To be safe, you must send him a certified letter advising him to move the vehicle within a specific period of time, stating the action you will take if he fails to comply. After the 30 days has expired, it is then reasonable to dispose of it.

    Keep records of all correspondence and communication.

  9. I would just call up the local police department and have them give you suggestions that way you have proof and they can't come back and sue you are anything like that even if it was legal.

  11. Don't see why not, it's your land and he has something on it. Did you make a copy of the letter you sent him?  Even if you didn't, it is kinda like him trespassing and leaving something on your property. You can have it towed off your land if you want.

    I say when you do have it towed to let him know when it will be towed, possibly have a police officer there...
