About Child support! Please answer

I have full custody of my 4 yr old son. In May 2008 I went to court for child support. The father at that time didn't have a job, so the judge ordered him to seek at least 20 employments before our next hearing and to show proof that he did look for a job. The next hearing, the father never showed up. But I did told the judge the father had worked at mcdonalds and don't know if he is still employed there. So finally the court order came out to be that he owes $2,400 as of December 2007 and his child support monthly payment is $301 plus payback of $50 a month starting August 1, 2008. But I still haven't receive any child support for my son yet, what's gonna happen to the father if he doesn't pay?

  1. Nothing.

    There's no debtors prison. He won't go to jail if he doesn't have the money.

    They'll increase his bill and send him nasty letters, but they can't make him pay what he doesn't have. They could potentially arrange for money to be taken from his paychecks, if he makes a certain amount.

    If he does have the money or property/assets, they could potentially sieze  his assets to pay you the money he owes, but A.) he has to have assets and the B.) you'd have to go to court for the money.

    My fiancee's mother is owed tens of thousands of dollars of child support from a man who CAN pay...and is in the middle of a nasty court case. She hasn't seen a penny...and now her children are grown, but she's sueing for back money owed.

    Good Luck, but if you're counting on that money, it' best of you come up with additional sources of income.

    If he contnues to fal to send support  they will put him in jail.

    Sounds like a ner-de-wel type of guy.  Good luck,  I doubt you will ever see much money.
