  1. Using a statistical definition of behavior:

Involvement in a protest rally could be viewed as a deviant behavior.  This is because the critical aspect of the definition of deviant is that it violates social norms.  If we argue that social norms are dictated by the majority then it could be argued that participation in fringe group activity due to its statistical rarity could be seen as deviant.

Using the more commonly accepted definition of deviant behavior:

Participation in a protest rally would not be a deviation from social norms because it is a critical aspect of American society that we can protest.  It is acceptable for us to engage in protest activities (providing we do so under the restraints of some formal and many informal social control elements).  Elements of formal social control are mandated through a contract with our society as a whole (and similarly through our consitution) to permit protests.  However, informal social control mechanisms may dictate to the individual that such behavior is not acceptable.  Rocking the boat is often not a favorable behavior.  It is often not encouraged by parents and certainly not by the public school system.  Schools certainly blur the line between formal and informal social control mechanisms, but the point is still valid.  They do NOT encourage deviant behavior.  Even thinking outside the normal box is often put down.

Therefore, there are really two good answers to this question.  Both yes or no can be argued with equal efficacy in my opinion (oh I love sociology for that reason).  Change the definition or how to come to the solution and the question can be warped around a correct response.  Good luck!

  2. Assembly (exhibiting protest or support) is guaranteed under the U.S. Bill of Rights.  That doesn't mean certain 'protesting or rallying' individuals will always act within the bounds of decent society, which can, and frequently may involve deviant or riotous behavior.
