when are you seposed to file the form i-751?

i just applied for my green card wich was about to expire in october. its my first time renewing the green card..i have been married for 2 years and 4 month. was i seposed to apply fo rthat when i applied for my green card renewal??

  1. Is your current green card a 2-year or a 10-year card?

    From what you're saying I understand it was a 2-year one, meaning your LPR status was conditional.

    Pursuant to that, you have to file I-751 to remove conditions, and once approved, you will get a 10-year green card.

    You're expected to file I-751 within the 90 days preceding the expiration date on your green card, so if your green card is set in October, July is the earliest month you could apply within, although keep in mind the 90 day limit. If your green card is set to expire 10/5/2008 for example, then the earliest day you can file I-751 is today.

    Anyway, yeah, it sounds to me like you needed to file I-751, and you probably filed I-90.

    I can't tell you for sure whether your I-90 will simply be returned to you (with the check uncashed) or if they will cash the check, process the application and deny it with the reason that you needed to file I-751, but you must file I-751 anyway, so better get started on that!
