Question:

About my husband's unpaid speeding ticket?

My ex-husband got a ticket last year in another state. It was almost five hundred dollars and he has never paid it. Is it a possibility that he could have a warrant out on him, and is there a way to look it up?

  1. $500 ??? How fast was he going? I would contest a speeding ticket of that amount myself!

  2. Yes, in Canada he would have a warrant out for him.  If he didn't pay it or didn't attend the court date on it (to try and fight it), then he would have a warrant.  A way to look it up in Canada is to call the Registries office (license issuer).

  3. Yes, when he failed to pay the fine or contest it in court, a bench warrant was issued for his arrest.

Generally, if a person is found to have a bench warrant against them when stopped by a law enforcement officer, they're immediately taken into custody, rejailed and a hearing is held at which time a new bail amount and conditions are set and a new court appearance date is scheduled.

By not paying the fine, your ex-husband has put an asterisk next to his name. The next time he gets arrested, the court will automatically judge him as a "flight risk", and probably deny him bail.

As for looking it up, that's risky. His best bet is to contact a lawyer to represent him and see if he can't simply pay a fine and get the bench warrant vacated. After a year, though, it's hard to say whether the court will be sympathetic.

    Good luck!

  4. He has a warrant. He can call that department and ask them but he's wasting his time. He has a bench warrant for his arrest.

  5. Yes he does. What will happen is every time he gets pulled over he will be taken into custody. Here is the good news, since it was in another state they will not extradite him as long as its a misdemeanor traffic violation. The state will not pay the money to do so. But he will probably have a hard time renewing his current license. Pay the fine and THEN call the issuing court to find out if there is a warrant.

  6. He does has a warrant out for him
