Question:

About to open up a daycare i put the application in they said i have to do a back round check?

the problem is that my daughter who is sixteen has been arrested for fighting her boyfriend and a girl at the school and also stealing . she also has charges pending on her now , will that stop me from getting my license in Illinois .

I don't think your daughter's record will reflect upon your background check.  She is a minor, and while you are responsible for her, that is not the point of the background check.  All they are going to look for is whether or not you are a s*x offender.  They may also see if you have ever been arrested.  You don't have anything to lose, because your daughter's record won't disappear (maybe when she's 18, I'm not sure, though.)  Anyway, I would go ahead with the background check.  Best wishes to you!


  2. I don't know about Illinois...but I just got licensed in MN and I had to make my Mom move out because she had a bounced check in her past. I am not kidding either. They told me that fraud or fraudulent acts is automatic disqualification. I can file for what they call a "variance" since it was over 3 years ago but that takes a long time so I had to make her get her own place sooner than she originally planned because I couldn't afford to wait longer for my license to start bringing in my income. I believe theft is also under the fraud category but the best person to ask is your licensor. If you don't want to ask you can usually find the rule guidelines on what will and what won't disqualify you. You may be disqualified but you may be able to get a variance which will allow you to be licensed under certain provisions. (i.e. daughter never alone with children, etc.) Good Luck. I know how hard it can be and my Mom's background has taken four months and officially it is still being studied. But now that she is out, I am licensed since me, my husband and my 13 year old passed the background study. I just can't have my mom over during daycare hours. So  good luck....hopefully it will work out easier for you than it did me.

    PS..in response to above....that is not entirely true. They want to know about EVERYONE over 13 in your home or that will have contact with the children and as stated before by me it is not just about s*x offenders. Make sure you look up online on the county or state website...they should have the rules posted where you can determine what you should do next

  3. I'm not exactly sure about Illinois but in Kansas the background check is simply to see if you have ever been charged with a felony or have had any child abuse arrests in your past. Your daughter's troubles should not affect your ability to get a license. Although her troubles may affect your business.

  4. Short answer yes. There is a very good chance your license will be denied.

    To be blunt, You should not be allowed to have a daycare if the kids will be exposed to your daughter. You have a moral and legal obligation to prevent kids from coming into contact with violent people or people prone to criminal behavior. Your daughter is a civil liability to you and if somehow you get your license, I would not be at all surprised if you find yourself in court being sued and losing everything you own.
