Question:

Accident at a parking lot... 6 months ago... Need answers please!?

ok, so my mom & my 11 year old brother were walking at parking lot towards a store when all of a sudden this lady was not looking & didn't stop for them to cross. My mom saw & stopped but couldn't pull my brother out of the way fast enough. This lady stepped on the brakes hard but still hit my brother. Then they moved & didn't hear from the lady's insurance company until a couple of weeks ago when they received a letter from the lady's insurance company. I called 'em & I'm now waiting for them to respond. There a hospital bill & my brother can't play as before cuz his leg bugs him a lil when he wants to play tough... My question is... are they still gonna do something for my brother even though it's been 6 months of the accident???

  1. You have to contact the insurance department in the State where the accident happened and make a formal complaint.


  2. You mean that there was 6 months of no information or contact whatsoever?  If so, then after that amount of time, they probably don't even care, if they really cared, and the insurance company was going to do something, they would of at least of kept in contact with you

    They should either say they can't/won't do anything, or do something then, not leave you in the dark for 6 months

    If you still have their phone number, call them back, tell them what happened (give them a case number if you have one), and tell them they have a week to give a yes or no response (you have to prove that you mean business), if they say no, then there is nothing you can do, if they say yes, then play phone tag until you get the money, if they respond, but don't give you a definitive answer, then wait another week or so and call back (keep a log of everything you have done, the longer the log, the higher chance they will do something), if they don't contact you whatesoever, call back, tell them your information, then tell them if they don't give you a yes or no answer, that you will sue/report to police

    The thing is, they have to right to say that they can't give coverage/pay you, but if they say that they can, and don't do anything, or if they don't at least stay in contact with you, that is illegal and can remove their business license and they will have to go out of business, in other words, they at least have to say something

  3. Get a lawyer. He will make sure you get the money you deserve. It could be quite a bit. Don't let the insurance company drag things out and do not rely on them.

  5. Yes they will but only if you take action. My father got hit and died. The driver ran away and his insurance didn't do anything claiming he wasn't the one driving. Anyway all we did was get a lawyer and that's the only way we could reach them. It might take long for you to get your problem solved but I suggest you do the same. Get a lawyer, he would only get paid if you get paid. That's where his mmoney is going to be coming from.

  6. As long as you have not received any settlement money and cashed the check, you are OK.  My advice is to check with a Personal Injury lawyer.  You have the right to sue the Insurance Company and the lady who hit him.  You will need evidence that your brother cannot run and play as he used to.

    6 months is well within the Statute of Limitations for accidents.

If the insurance company will not pay the medical bills, I would recommend that you seek the advice of a Personal Injury Attorney in your state. Most attorneys do not charge for a consultation. In Virginia, for example, I believe the Statute of Limitations is 2 years, so a person would have 2 years to make a claim/file suit against someone for personal injury.

    however, since the woman contacted her insurance company, you will be compensated but it will take time. you should have had a lawyer represent you.

  10. well when my dad fell of a ladder a whew years ago he broke both of his arms. he can do stuff tho. you should sue the lady and she will probably go to jail. i think it might be ok but I'm not so sure sorry i cant help.

  11. don't wait for them to respond, since you have letter from their ins. take same to lawyer because they will wait until YEAR is up and if you have not file claim you have lost out on med. bills or anything else. do no let them intimidated you by saying you do not need lawyer

    they have more than one to do all kinds of things for them. you can bet your bottom dollar it will not be in your favor. rember only one year from accident.

  14. I don't see why not.  As long as everything was reported the day of the accident, the paperwork is good.  It's just a civil case at this point.  If the responsible party doesn't cooperate, you may have to pull them into court for some money for your brother's injury.

  15. Chances are they'll want to talk to your mom and not you.  We can't answer the question.  Your mom will need to talk to them to see what's going to happen.  Have your mom get a personal injury lawyer.
