Accident happened, your fault, no car insuance.....?

It happened in June 2006, I left my phone number with the other driver. He did not have uninsured motorist on his plan....but said he is not pushing anything that I would have to pay. Still the Farmers insurance attempted to make collection of payment and then it got passed to a collection agency, now there is another debt collector who added more to the charge of what was originally owed. Can they garnish wages? OR How can I tell if this is another debt collector just trying to get paid? (It does not show up on my credit report)

  2. Uninsured Motorist coverage is usually required by the state.  Under-insured Motorist is not.

    Uninsured Motorist pays when you get hit by someone who did not have insurance.

    If Farmers attempted to collect payment from you - that means that he did have Uninsured Motorist coverage and Farmers paid him for the damage you caused.  The damage you are legally responsible for.

    Along with turning you over to collections -- Farmers can sue you, get a judgment against you, have your drivers licenses suspended.  

    Had just responded to Farmers when they tried to collect from you---- they would have set up an interest free payment plan. You could have paid them 50 per month until the debt was paid in full -- interest free. No additional fees, no damage to your credit, no getting your license suspended.

    But since you ignored them, they are taking further action and collection agencies add fees to the debt so the amount you owe goes up.

    The other driver got paid by Farmers.  When that happened he transferred his legal right to "push anything that I would have to pay" to Farmers.  It's not his decision anymore. He has been made whole by Farmers. The decision to pursue repayment is now theirs.

  3. Yep, if he collected through his insurance, and it's your fault, his insurance is alloed to collect from you.  Plus court costs, plus legal fees, and plus interest, once there's a judgement.

    Yes, they can garnish your wages.

  4. it sounds like the person you hit filed through his insurance company and they paid his claim.  now they are wanting you to reimburse the claim. (which if you were at fault you are legal liable to pay)  since you didn't pay it, they sent it to collections.  You need to contact the collections agency and see if they will allow you to make payments on it if you cant afford to pay it all at once.  it WILL show on your credit sooner or later!
