between the ages of 14-16 the driver was 15, they hit the passenger side my sister was driving she's 22, I was on the passenger side w/ my little sister who is 7 in the back passenger side. When the accident happen it was during mild traffic and the hwy called Tara Blvd. which is a 6 lanes 3 headed north and 3 south. they had just come from eating at a restaurant which sit on Tara Blvd. We had just picked up a prescription ending our day by heading south on tara to go home and on the very outer left lane and here they come pulling out of the restaurant crossing two free lanes and into our third lane, hitting us on the front bumper of the passenger side, car was smoking. What suck was they did not stop at the scene of the accident they cross the next light and we had to chase them down into this fitness house. I do not have full coverage but I want their insurance to pay, in which they keep giving a twisted version. How do I make them liable, make the teen pay, the legal way

  1. I do hope you called the police and filed an accident report at the time of the accident. If you did, then turn that over to your insurance company and let their lawyers fight to get your compensation. If you did not file a report, Good luck, because you don't have any proof that it really happened.

I just hope you did and they have insurance and were driving legally, because if the teen was not driving legal, with whomever in the car with them, then their insurance probably won't cover them, in which case you will have to take them to small claims court and get a judgment against them.

  2. Well since they are under 17 you will need to go after the parents and their insurance.

As stated above I hope that you got a police report for this accident.

I have seen this before and you will win and if you need a witness you can put an ad in the newspaper and offer a reward which you will be getting back if this goes to court.

  3. Aren't you suppose to stay @ the scene of the accident & let the policeman handle it?

If they hit you on the front, near the passenger side, then they had to pass you by on the simplist side to get passed you.

I wonder did they hit anyone else going the wrong direction, in the wrong lane?

Did anyone else see this happen?  With all those people on the road, you'd think someone would be willing to be a witness to this.

Instead you chase them down in UR car(?), leaving the scene of the accident.  You & UR vehicle just left to go chase the person who hit you.

Or is it the other way around & you just want them to pay for it.

They could of gotten the book slammed @ them for hit & run & instead you follow them(?).

I believe it is now, one person's word against another.

  4. I know Tara Blvd (aka 19/41) very well. I worked at the jail just South of Hwy 138 for 3 years there in Jonesboro. Your gonna have to get the police involved if you haven't already. Secondly, confirm all the conflicting insurance stories by calling their agent. Then get a lawyer. As a teen under the age of 18, their parents are going to need to be drug into this. Afterall, no teen under the age of 18 can own a car. So someone does. Yes, getting the law involved sux. But that's what it gonna take. That's all the advice I can offer you today.

  5. Did you call the cops, did they make a police report, did you get their insurance info, if you did all this and the teen was in the wrong then their insurance will have to pay for your repairs.
