Accident/moving citations?

I got into an accident last Saturday and I was given two citations:

Failure to control speed to avoid collision

Failure to yield/left turn

My insurance company told me that the speeding ticket was a bit harsh. Others have told me to refute it. I wasn't speeding I was going about 3-5mph trying to turn in an intersection. Should I contest this one in court?

  1. Unless the officer actually witnessed the accident and used some sort of equipment to record your speed (which would be noted on the citation), I would contest it.  

    Typically, people aren't often cited for excessive speed in an accident unless they are skid marks that can be measured, or the officer actually witnessed the accident.


  2. apparently you are at fault for the accident and the failure to reduce ticket is just a given ticket in this area.  You had an accident and if you would have slowed you wouldnt have gotten into the accident---thats how they look at it.  It really depends on the whole situation as to whether to fight the ticket or not.  However you didnt stop or yield according to your tickets so the ticket will stick.  Lawyers give free consultation---call one!!  Good luck.
