Accident...?

had an accident where a cyclist rode into my car and now he is trying to claim of my insurance. he is trying to claim for tissue damage,concusion anmd cuts and brusies. does anyone know how much this is likely to be? thing is he wasnt wearing any protective clothing or helmet!

  1. Clothing or helmet is irrelevant.  

    If he rode into you, you can countersue him for damage to your car.   If YOU are at fault for the accident, turn it over to your insurance company, so they can defend you.  That's what you pay them for.

    It's possible it will be NOTHING.  Or, maybe it will be $5,000.   It doesn't sound like he's badly injured.

Hard to say what, if anything, he is entitled to.  The case value will vary from state to state.  Also, depending on where this loss occurred, he may not even be tort eligible.  The threshold requirements vary from state to state.  Some are monetary, some are verbal, and in others the injured party has to sustain a "serious" injury.  

    If you live in a No-Fault state, you should have PIP coverage.  This will pay for his medicals and lost wages.  

    If he is in fact tort eligible, the claims adjuster will evaluate any potential settlement based on the nature and extent of his injury, treatment, disability, and permanency, if any.   His percentage of liability will be deducted from the settlement.  

    In some states, even if he was only 1% at fault, he would be barred from recovery.   The comparative negligence rules vary just like the tort threshold requirements.

  4. if you want, you can give him the insurance, but then report him to the police for not wearing a helmet and the police will deal with him ..

    but if you are not the one who amde the accident, just relax n sit back.. if he does try to claim, just tell him that u can report to the police n tell them the whole story....

    if you are the one who made the msitake, u gotta allow him to get the claim
