My friend Tom got a letter in the mail by the police saying hes accused of sexual assault, now hes 22 years old but they were dating last year so he was 21 and his ex-girlfriend was 18, but they broke up like a year ago and just yesterday we got that letter saying he accused of sexual assault. When they were dating you know obviously they had s*x but he never forced her. So in this situation what happens? does he go to jail or what would happen to my friend?

  1. Police do not send letters in the mail accusing anyone of anything especially a s*x charge.

  2. Your friend is screwed, honestly.  His ex-girlfriend is pregnant and the mom and dad is pissed off because of the breakup.  California take sexual assault very seriously.

You mentioned it is been a year since they break up.  He might want to find out if she dated other guys after his break up. If pregnancy was the issue.

TELL HIM TO GET A GOOD LAWYER!

  3. It's spelled L-A-W-Y-E-R. They haven't entire swallowed her story, or he'd be in the jug already. I kind of have to wonder if the letter's real or one of his friends (or enemies) is jerking his chain. It's safe enough to call the person who sent the letter to confirm the situation.

  4. Sounds like your friend's ex is messing with him.  The police would have no reason to send a letter stating he was accused of sexual assault.  Either thay have enough to arrest him and they have a warrant out for his arrest or they don't and nothing will come of it.

Lawyers are good people to know though...

  5. he should have a fair trail, and if there is no evidence at all, he probably wont go to jail.

his girlfriend is probably hurt about their breakup and trying to get back at him in the wrong way.

also, what  makes you 100% sure he didnt force her or do anything else that she may find as an offence? you werent a witness so you probably dont know for definite, even if you really trust him.

If his ex is lying then she can get charged for claiming a false assault.

Only 6% of sexual assaults result in conviction anyway.
