I need some advice here I was arrested for an assault that was supposed to take place in Jan of this year. Charges were filed in July now I didn't do this I just didn't the woman accusing me of this was involved with my ex husband and believed that I was trying to get back with him. I was not and would not get back with him or have any reason to hit her. The only time I was there in Jan was one time to pick up my child that's it I then went back to North Carolina I moved back here in March and she filed charges in July I was arrested last week I guess I'm asking how can she do this and what can I do now?

  1. Well, did you TOUCH the lady AT ALL? If not, then get a lawyer.  If you DID... ha, woops... your bad.

  2. You get a lawyer.

    You don't do anything else.

You don't ask random people in the Internet, for crying out loud!

    You get a lawyer!

  3. You need to go pay for your own lawyer, forget the state defense attorneys they are free and don't care.  Scrape up, borrow whatever you need to do to get your own defense lawyer.  Do not plead guilty! This is a serious charge.  Take it to trial!  Even if you did it, it's still your defense of why she waited 7 months to complain.  Were there any witnesses?

  4. Assault does not mean you touched her. Assault means that you said something that made her fearful that you would hurt her. Battery is actual touching.

  5. First thing you do is hire a lawyer. You are going to need one.
