Acknowledgement of Paternity?

My daughters father was not present when she was born. So she has my last name. How would i go about getting her name changed and his name on the birth certificate. We live in Texas

  1. Ok, I went though this in Texas as well. Since the father and I weren't married at the time (we are now), I had to go through the Attorney General to get a DNA test.  (No, we weren't together when she was born, long story.) Once she was proven to be his child (which we knew all along), we had to go to a court hearing. They issued us the results of the paternity test, and gave us court orders to change her name and birth certificate. I also had the opportunity to set up child support at that time. We were back together by then, so we didn't worry about that. Then, we got a certified copy of the court order and sent that along with the form on this website http://www.dshs.state.tx.us/VS/reqproc/a... to the address listed there. When we got her birth certificate back, we took it to the social security office and changed her last name there.

    It was a long, drawn out pain in the butt for us because different people kept leading us in the wrong direction. Hopefully, the information I gave you will make things go more smoothly than they did for us. :)

    Also, this was 6 years ago. You probably want to thoroughly read over that link I gave you to make sure procedures haven't changed since then.

  2. ok im going thru the same thing! and whats strange is my daughter is 16 yrs old...he has finally owned up and wanted to be on there! so i did the research....we paid 43 dollars and his signature was all that was needed and they reissued a new birth certificate..just call ur local court house for an appointment! oh i live in texas too! =]

  3. He would just have to approve the name change and sign the paper acknowledging paternity and get his name on the BC.  As long as he wants the name added there shouldn't be a problem you just go together to get everything taken care of.  

  4. If you are two aren't married than you will have to file a petition to change her last name and if you have his signature then you can place him on the birth certificate at the same time but you do not need his signature to change her last name.  

  5. You have to do a legal name change and then get the birth certificate re issued. Check on the txdps website and you can download the forms or you can buy a legal name change kit at office depot and they have all the forms to get the new bc and ss card if one has already been issued.
