Acumulate vacations are suposed to be paid when you leave a job?

my husband is working for this company and he find another job, he talk today and he is working for 1 more week, he start his new job this 25 and in his job they said that they cant paid his vacations because he didnt report his leaving with 3 weeks of anticipation, Can this be possible?

  1. accrued vacation time is usually covered by company policy and not any law, depending on your state of residence

    Tort laws makes a distinction between entitlements (like paid vacation time) and benefits (sick time, bonuses).  In most states they have to either continue his employment until the vacation days run out or pay it in a lump sum.

  4. It all depends on the agreement made when he was hired and your state's labor laws.  Generally not giving sufficient notice that you are leaving is cause to not fulfill the severance package agreement.  You and he will have to do some research on the employment agreement and the law.

  5. Yes they can.  There are no laws that address this.  Most companies have a written policy that addresses this issue.

You did not say where you are.  In the state where i live, there are NO laws about unused vacation time,  My employer does not pay unused time.  Depending on how much time you have taken and how far into the year you leave, you could actually owe them for time used begfore it was earned.  On the other hand, if you part on good terms, you can often take your vacation time and officially leave the last day of your vacation.
