Additional question: Assume that returning to a country of origin may lead to arrest...?

Ok...he has the green card. His passport is recently expired. And his home country could choose to arrest him or detain him rather than renew his passport. It is possible that there is not an US embassy in his country at this time (Belarus).

Are there any other options...or is he limited to US residency for the next two years?

  1. His expired passport must be renewed at the nearest consulate or consular section at the Belarus Embassy.  He cannot stay here on an expired passport.  If he is wanted for criminal charges in his home country, they can extradite him, and the US can cancel the green card of a fugitive criminal/criminal suspect.  His US residency is in jeopardy if he does not renew his passport and straighten things out with his government.


  2. He's just going to have to stay put until he gets US citizenship and a US passport.

    He DOES NOT need a passport unless he intends to travel outside the United States.

  3. It's possible that the US will revoke his green card if he is evading arrest in his own country by residing here.  It's certain that they won't renew it.
