Adopting... my fiance plans to adopt my children after we are married

my children have different fathers. one is not involved what so ever.. only pays court ordered child support.. the other also is supposed to but recently quit his job so he does not have to pay so much.. but he "tries" to be involved.. sees him when ever its convenient for him.. blah. my question .. since the boys both have my last name and the fathers do not have any type of custody, do i have to get the fathers to give up parental rights for my husband to adopt them?

  1. Since there is court ordered child support, then they are named as the fathers.  Yes, you will have to have them sign away their rights.  Sorry.


  2. Yeah, I think you would have to get them to sign over their rights. I asked the courts if I could have my baby's father sign off his rights and they said if I got married, and he willingly signed off the rights than yes, I could have her get adopted by another man. It might be different in different cases though, to be sure call up legal aid or some type of legal advisor and ask them about the situation, they should be able to tell you over the phone how it would go.   3. yes, they have to give up their parental rights, no matter who's last name they have.
