  1. Yes, she can legally "take you" if the court finds that she is mature and responsible and places you in her care and designates her as your guardian.  But it will depend upon who has custody of you now and whether they are willing to relinquish that job to your sibling if they are a mother or father or have been appointed already by the court as your legal guardian.


  2. It probably depends on your state, however, I think the chances are good if your parents aren't around, have abandoned you or will agree to this in front of a judge.

  4. Technically it is possible but usually people would not want them to because of college or something that mite get in the middle of them taking care of the sibling. If they do let them adopt the sibling, there mite be social security people keeping an eye on u for every week.

  5. There is no reason for adoption. She can apply for custody if for some reason you do not have at least one parent who can take care of you. She would have to prove to the court and Social Services that she can take care of you. On the other hand, if you are simply trying to get away from your parents to live with her because you think it will be better you won't have any success unless the court decides they are inadequate.

  6. I am not even sure if a sibling can adopt a sibling legally.  

    Pursue guardianship rather than adoption.  It is cheaper and easier.   As far as the rights that are involved legally, there is very little difference between the two.  The major difference is (I believe) that the guardianship automatically ends when you become an adult and can perform the duties that the guardian performed for you previously.

  7. A judge isn't likely to allow a sibling to adopt a sibling unless there is a huge age difference. However, an 18 year old can become guardian of a younger sibling no matter what the age.  Happens often.

  8. Not if you are a minor and your parents are your legal guardians.  They would have to give up their rights or pass away in order for the possibility of your 18 year old sibling to become your guardian.
