Adoption of Grandchild?

So, it's a very long story, but my mother has agreed that my brother & I are going to live with my grandmother about 3 hours away (my mother can't support us).

I'm 15 and my brother is 17. Right now, my mother has full custody. What process would we have to go through for my grandmother to have legal custody of my brother & I. Also, would we be able to have it complete in less than two months so we could register for school in my grandmother's town?

  1. in order for your grandmother to have full custody you have to go thro court and all that kind of stuff w/ lawyers and c**p


  2. your Mom can take you there and register you for school. Then get a paper typed up giving your grandmother guardianship of you  and your brother. That would be the easiest and quickest way. But when she registers you she shouldn't tell the school at that time.  This could be done in a matter of days.  Or she could file for a court hearing to give your grandmother guardianship, but that might take a month or two. If she does it herself then she can choose to have you go back with her anytime, but going thru court , then she'd need to go to court to get you back.  I have seen the guardianship forms online or in a book of legal forms at the library.

  3. you don't have to be adopted to register for school.  you have to live in your g'mothers county or town.

  4. my mother lives in montana and sent my 13 year old sister to stay with me for a while (she was 11 at the time) well here it is 2 years later and i have never had a problem registering her for school.... and i went to the court house and filed for gaurdianship.. i didnt have to adopt her...

So sorry that you are in this situation.  Your grandma can get guardianship within a few days, which would allow her to register you for school.  Contact Social Services to find out exactly how to do this.  Your grandmother may not even need a lawyer (social services sometimes handles all of that).  If she later decides to actually adopt you, that will take more time, but you can already be living with her to accomplish that.

  6. you dont have to be fully adopted to register for school... if she has full custody then you can register. I wouldnt worry about getting adopted since you guys are soon to be adults. But if u really want it it is a long process, so i dont think it can be done in two months, but i would call the local Health and Human Services office and ask them...

  7. Please ask your mom and grandmother to look into Kinship Care in your state.  It is much less formal than adoption and does not take long at all.  It will allow your grandma to care for you, register you in school, and she may be able to get some benefits for you.  See this WEB site -

  8. Your mom and grandma need to talk to a lawyer, and arrange for PHYSICAL custody to be transfered, while your mom keeps LEGAL custody of you.  Once your grandma has physical custody, it should be easy for her to enroll you in school.

    A family court will probably assign you a social worker, who will make  a home study of your grandma, to assure that you and your brother would be better served in her home, and will report his or her findings back to the judge.  Unless there is a serious problem, the judge will usually rubber stamp these things.
