Adoption of Someone You Already Know?

I have a friend who's parents are moving out of the country on business and want to leave her here with us. My mother wants to adopt her and her parents agree. Where would we get the papers to adopt her? I live in Ohio.

I agree with Heather, perhaps a guardianship is more appropriate in this case.  If the bio family terminates their parental rights, the child loses all benefits from them also including any death benefit, etc.  This may be something they are not aware of as it seems that they want to do what is best for their child.  

    I would recommend contacting an attorney in Ohio that specializes in family law, not just adoptions.  He should be able to discuss the options available to your friend's family.

  3. In order for your family to adopt her, her parents will have to file to have their rights terminated.  Both will have to be filed at the same time (adoption/termination).  The adopting parents will also have to have background/criminal checks done.

    It's a bit complicated and and varies state to state.  It is best to use a family attorney.  Good luck!

    In any case you need to get in touch with lawyer who deals with family matters.  Some will offer a free initial consultation or even a telephone or email initial advice.

  6. It's not just getting papers. In Ohio you need a full home study and get clearance from the "child abuse reporting agency" which can take 6 months.  there is a lot involved and could take a while. How old is she?

  7. I would suggest that you get an attorney that specializes in adoption- so it can be done legally.  Just thought about something though- how old is your friend?  If she/he is just a baby ok- but if she is older, how could the parents give the child up over business. I just do not understand.

  8. I think that is kind of your family. Why would they want to leave her behind, though? You'll have to go through an attorney to have the papers drawn up. It sounds like it will be simple because you state everyone is in agreement. Good Luck!
